This private preliminary agreement does not transfer ownership — only a notarized deed followed by registration at the land registry finalizes a real estate sale in Algeria.
Between the seller, , holder of national identity card no. , and the buyer, , holder of national identity card no. , it is agreed as follows: the seller promises to sell, and the buyer promises to purchase, the property described as follows: , at an agreed total price of ().
Upon signing this agreement, the buyer shall pay a deposit of , which shall be deducted from the total price when the final deed is executed.
Both parties undertake to finalize the sale by notarized deed before a notary within from the date of this agreement.
Should the buyer withdraw from completing the sale, the seller shall retain the deposit as a lump-sum indemnity. Should the seller withdraw, the seller shall reimburse the buyer twice the amount of the deposit paid.
The parties acknowledge that this agreement does not transfer ownership of the property, which will pass only by the notarized deed and its registration with the land registry (conservation foncière).
